Some State Attorneys General are questioning the legality of mandating an individual buy a Health Insurance Policy. Here is the story from the New York Times. The argument for is tied to the states mandate that a person buy Automobile insurance. The Attorney General of Florida, William McCollum, a Republican who is also running for governor in 2010 argues that the mandate “would penalize people who choose to do nothing, compared with the car-insurance requirement, which is connected with the decision to own and drive a car.” Also, generally the mandate for Auto coverage is General Liability which protects OTHER PEOPLE from damage which the driver causes. Health Insurance is designed to protect the individual who purchases it, not others.
