I updated my prior blog post with the EXACT citations of the Code of Federal Regulations. Thanks to ”KT” for helping me find the citation!!
I feel this is even more and even stronger evidence that Original Medicare and PDP replaced by MA or MAPD is INITIAL COMMISSION and not RENEWAL, since the replacement is not LIKE PLANS as specificially defined by the Code of Federal Regulations!
I will be e-mailing this to the Acting Director of Medicare Drug and Health Plan Contract Administration Group tonight for her review. Thanks to Kristin for supplying the introduction and contact.
Craig- I agree with Honest American Businesswoman. Please advise as to what we can do on our end to make sure we are paid CORRECTLY!I have been in the medicare supplement business for 23 years(I worked with my dad for 5 years just as you do now).The independent companies I represented always upheld their contracts.We,as agents, expected them to…AND THEY DID.In all these years, I have never seen a travesty of injustice in the insurance business as we are seeing right now. They can’t just keep changing the rules(or maybe they think they can because of who they are) as the game moves along.My kids know that and I bet yours do too!I wish we could get this group of criminals(err…I mean people…) cornered in a room so we can really let them have it! Because what CMS is doing really is absolutely criminal and they should be called on it! I get the feeling they thought the agents would just let things slide. They thought WRONG! If I do nothing to fight back, I’ll always regret it.So please advise as to what my best options are. Again, Craig, thanks for all your help!

As usual, I will wait and see what ACTUALLY happens as I have no faith in CMS and their ability to get it right. I only know that my clients have confidence in me and are appreciative of what I do for them.
Why aren’t more agents demanding that CMS turn commissions back to the companies so we get paid promptly and correctly in 2010?

We will all fight to correct this injustice together, you as our leader, and we will bring trust and integrety back to the industry. Let us rekindle the spirit where a contract was upheld and a promise was kept and people actually trusted their insurance carriers to be just and fair. Let us start by correcting this wrong.
