I get so tired of people like Pete Stark and Sen Bacus accusing all insurance agents of being crooks. They need to clean up their own House of Representatives and Senate before they accuse anyone of anything. But, then, that is politics.
The thing that really burns me up is the people at Humana and United Health Care essentially calling their own agents and the rest of us crooks.
We all know that when someone’s house burns down, or they have a car wreck, get sick, or have a death in the family, that one of the first people that they call is their insurance agent or the company they represent. They may not be thankful for their agent in particular but they sure are thankful for the money they receive to help them recover their loss. Ususally the only regret they have is that they didn’t have more insurance!
Information in the bulletin is somewhat similar as to “rules” set-out by my broker-dealer regarding the sale of annuities (fixed,indexed,variable) and life insurance (indexed & variable), although, I don’t yet have to get a “permission” slip to see the prospect. We are encouraged to thoroughly document our interviews, get additional disclosure forms completed and filed with the applications when they are mailed in. I have not yet received anything back on my inquiry re: will the CMS rules also apply in these situations?…..I hate to see what my E & O rates are going to look like. So far, most prospects are merely putting off serious buying decisions with the dollars going into MMF’s, savings accounts or short-term CD’s at 4%….Time will tell.

Let’s just think outside the box for a moment. I believe this whole cut in commissions baloney is company contrived. Apparently, the companies did not fare well in the latest contracts for 2009, so they have enlisted the help of CMS to take the fall, as it were. CMS has nothing to lose. The companies have a lot of money to lose. By cutting our commissions, it enhances their bottom line – just like any other business. The companies conspired and threatened to pull out of the MA market because of the unfavorable 2009 contracts with CMS if CMS didn’t make it appear that IT was to blame for this fiasco. CMS has gleefully gone along with this ruse. Everybody out there is taking a pay cut – we might as well, too. We’ll just blame CMS. Everybody will accept that. I say, baloney.
Doesn’t seem to be anything new. This whole thing is still infuriating. If anything it encourages brokers to ‘scam’ so they can feed their families. DISCLAIMER: No, I don’t scam people, i sometimes feel like i’m one of the few people who will walk away if i can’t actually help somebody.

I wonder what NAIC’s take on all of this is. This just seems to be a rather late restatement of the current regulations.
No SELLING, of the Medicare Advantage Product – The client must take it away from you.
No discussing any of the advantages over what they have now – even though it is called Medicare ADVANTAGE.
No enrolling the client into a better plan – lest we cut your commissions even MORE.
