Here is the latest guidance/clarification which came out this past Friday. I’ll comment later if I have time!
Are we supposed to police other agents as well? What do we do if we follow all the rules and other agents ignore them? That person may get a lot more sales that we are prohibited from trying to get.
What a confusing mess. I’d be suprised if someone doesn’t get caught in any number of traps – not obvious to the intended audience…..Also, wouldn’t it be nice to have a universal disclaimer form, rather than any particular one; suppose the person doesn’t buy the product on the disclaimer but buys another??? Too many questions and too confusing…..I also had to “pass” at least 1/2 dozen company tests that also in various ways describe the CMS rules ….If this doesn’t stiffel sales I don’t know what wouldn’t.
